How to Find Out Who Your Defendant's Agent Is
It is free, it takes about a minute, and it is worth doing again right before you serve.
Search the Secretary of State
Go to the California Secretary of State's free business search at bizfileonline.sos.ca.gov and look the company up by its exact registered name — not the brand on its website or its invoices.
Read the Agent Field
Open the record and find "Agent for Service of Process". It will name either an individual with a California street address, or a company such as the ones above.
Send Us the Documents
Pick that agent above, or call us with the name. We confirm your documents are going to the right place, make the delivery and return a court-ready proof of service.
If the agent has a name but no address
Nothing is missing from the record. California Corporations Code section 1505 lets a corporation register as a commercial registered agent by filing its own certificate with the Secretary of State. Once it has done that, every company that appoints it is listed with the agent's name alone, because the address is held on the agent's certificate rather than copied onto each client's filing.
So a record that reads "CT Corporation System" or "InCorp Services, Inc." and stops there is complete. You just have to look the address up against the agent instead of the defendant — which is what the cards above are for. All five agents on this page are registered corporate agents of exactly that kind.
An individual named as agent is different: their California street address does appear on the record, because there is no certificate to point at.
Why Companies Are Served Through an Agent
A company has no front door in the legal sense. It cannot be handed papers, and chasing an officer around an office building is slow, expensive and easy to argue about afterwards. California solves that by requiring every corporation and limited liability company registered in the state to name an agent for service of process and keep that name current in a public database.
That agent is a standing, published answer to the question of where to deliver legal documents. Under Code of Civil Procedure section 416.10, delivery to the agent is service on the company itself. The company is served the moment the agent accepts the papers, whether or not anybody inside the company has read them, and the time to respond runs from that moment.
For you this is the easy route rather than the hard one. There is no skip tracing, no evasion and usually no second attempt: a commercial registered agent keeps regular business hours and is paid by its clients to take delivery. That is why serving a company through its agent costs less than serving a person at home.
What the agent will not do is anything else. It does not represent your defendant, does not appear in the case, does not file a response and has no opinion on your claim. It receives, records and forwards. Writing to a registered agent about the merits of a dispute is a common mistake and never gets a reply.
